By accessing the Platform and/or using the Services, you hereby agree to be bound to these Terms, which establish a contractual relationship (the “Contract”) between you and Montessori Family Lifestyle. If you do not agree to these Terms, do not access the Platform or use the Services. Montessori Family Lifestyle will not be liable for any loss or damage arising from your failure to comply with these Terms. Montessori Family Lifestyle reserves the right and sole discretion to modify these Terms at any time.

All collection of information shall only be done when your consent has been secured.

Change

If you object to any changes, you may discontinue accessing the Services.

A. Information From You

Registration

Profile

You have choices about the information on your profile, including but not limited to, your education, work experience, personal/ family preferences (such as interests, relationships, habits, etc.), your child’s skills and progress, and photos.

We collect personal data from you when you inquire, provide, or sign up for our Services, including but not limited to:

• Details of transactions you carry out through the Platform and of the fulfillment of your inquiries or requests.

• To provide you with information that you have requested or to respond to your inquiries.
• To provide you with technical support and to improve the Platform.
• To verify your identity and administer your account, including processing your payments and fulfilling your orders.
• In order to ensure that content from the Platform is presented in the most effective manner for you and for your computer or mobile phone, to allow you to participate in interactive features of its Services (when you choose to do so), and as part of our efforts to the Platform safe and secure.
• To measure or understand the effectiveness of advertising it serves to you and that you have consented to, and to deliver relevant advertising of its Services to you.

A. Our Services

B. Partners

We use others to help us provide our Services (e.g., home supplies and services). By availing of our Services, our accredited Partners will have access to certain information you provide as may be reasonably necessary to perform their tasks and services, and are obligated to not disclose or use it for other purposes.

C. Related Services

With your consent, we may also share your Personal Information to third parties in order to provide and develop our Platform and/or Services.

D. Advertising, Marketing and Related Services

We do not share your Personal Information with any third-party advertisers or networks, other than our Partners, for their advertising without your consent. We may use data and information you have provided for offering, promoting, and availing of our Services and the services of our Partners.

E. Legal Disclosures

Montessori Family Lifestyle strives to provide you with choices regarding the Personal Information you provide to us. Montessori Family Lifestyle has created mechanisms to provide you with the following control over your information.

A. Preferences

B. Data Retention

We retain the personal data you provide while your account is in existence or as needed to provide you our Services. Unless otherwise required by law, Montessori Family Lifestyle will erase Personal Information when the Personal Information is no longer necessary in relation to the purposes for which was collected or otherwise processed; when you withdraw your consent (where lawfulness of processing was based on your consent) and there is no other legal ground for the processing; when you object to the processing and there are no overriding legitimate grounds for the processing; when your Personal Information has been unlawfully processed; and when it is necessary to comply with legal obligations.

C. Account Change

Montessori Family Lifestyle may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

D. Account Closure

If you choose to close your account, your personal data will generally stop being visible to others on our Services within 24 hours. We generally delete closed account information within 30 days of account closure, except as noted below.

We retain your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our Terms, or fulfill your request to “unsubscribe” from further messages from us. We will retain de-personalized information after your account has been closed.

LIMITATION OF LIABILITY

Montessori Family Lifestyle has implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, the transmission of information via the internet is not completely secure.  Although Montessori Family Lifestyle will do its best to protect your Personal Information, we cannot guarantee the security of your data transmitted to the Platform; any transmission is at your own risk.

• Montessori Family Lifestyle makes no warranty, express or implied, regarding the services offered by its Partners on the Platform.
• The use of the Platform and its Services are offered on as “AS IS”, “AS AVAILABLE” basis without warranties of any kind, other than warranties that are incapable of exclusion, waiver or limitation under the laws applicable to these Terms. Without limiting the foregoing, Montessori Family Lifestyle makes no warranty (1) as to the content, quality, or accuracy of data or information provided; (2) as to any service or product obtained from our Partners; (3) that the Platform or its Services will be uninterrupted or error-free; or (4) that any particular result or information will be obtained.
• Montessori Family Lifestyle shall not be liable for any goods or services offered or provided on the Platform or its Services. Montessori Family Lifestyle does not give any warranty whatsoever in connection with its Services or the services of our Partners.
• In the event that a claim is made or an action is filed by you against Montessori Family Lifestyle, any of its directors, or Personnel, the aggregate liability of Montessori Family Lifestyle its directors, or Personnel shall not in any event exceed the amount of damages suffered by you.
• You agree to hold Montessori Family Lifestyle and its Personnel free and harmless from any liability arising from acts or omissions of its Partners to you and/or any third party, and to indemnify Montessori Family Lifestyle against all liability, damages, losses, claims, costs and expenses, penalties and taxes, including legal costs, incurred in connection with your use of the Platform and Services.

NON-WAIVER OF RIGHTS

Failure, omission or delay on the part of Montessori Family Lifestyle to exercise its rights or remedies under these Terms shall not operate as a waiver of rights.

SEPARABILITY

If any clause or part of a clause of these Terms shall be, or be found by any authority or court of competent jurisdiction to be, invalid or unenforceable, such invalidity or unenforceability shall not affect the other clauses or parts of such clauses of these Terms, all of which shall remain in full force and effect.

GOVERNING LAW AND VENUE

These Terms shall be governed by the laws of the Republic of the Philippines and in the event of any suit arising from or in connection with these Terms, the appropriate court in Makati City shall have exclusive jurisdiction over the case to the exclusion of all other courts.
